2. The provisions of Article 38 paragraph 3, Article 39 (except those under paragraph 1, paragraph 3 and paragraph 4) and Article 40 shall apply accordingly to permission for the construction enforcement plan under the preceding paragraph.
However, the provisions of Article 38 paragraph 3, Article 39 paragraph 2 and Article 40 shall, regarding approval of the construction enforcement plan other than that under the provisions of the former part of the preceding paragraph in the case of establishing the New Tokyo International Airport, only apply accordingly when alterations are made to the extent, approach surfaces, transitional surfaces, or horizontal surfaces of the New Tokyo international Airport.

 

3. In the case of the preceding paragraph, “Article 43 paragraph 1” prescribed in Article 40 shall read as “Article 55-(3) paragraph 1”.

 

Article 56. The provisions of Article 42, Article 44 (restricted to the part of the deactivation of aerodromes), Article 45, Article 46, Article 47 paragraph 1, Article 49, Article 50, Article 51 paragraphs (2), (4) and (5), Article 54 and Article 54-(2) shall apply accordingly to the New Tokyo International Airport or to the air navigation facilities under the preceding Article paragraph 1 which is established by the New Tokyo International Airport Authority. In this case, “Article 43 paragraph 1” prescribed in Article 50 paragraph 1 shall read as “Article 55-(3) paragraph 1”.

 

(Exceptions of First Class Aerodrome, etc.)
Article 56-(2). The Minister of Transport may designate the extended approach surface, conical surface and outer horizontal surface for the first class aerodromes and second class aerodromes specified by a Cabinet Order.

 

2. The extended approach surface shall be a plane including the approach surface, and shall also be encircled by the outerbase of the approach surface, whose lines extend outward and upward along oblique sides of the approach surface therewith, and parallel to the outerbase concerned for a horizontal distance of 15,000 meters from the inner-base of the approach surface.

 

3. The conical surface shall be a conical plane, and shall extend from the periphery of an inner horizontal surface outward and upward at a slope, specified in Ordinances of the Ministry of Transport, of not less than 50 to 1 to intersect a vertical plane which includes the aerodrome reference point, and shall also be limited to that are necessary for securing safety of take-off and landing of aircraft within the projected lane encircled and having a radius of not more than 16,500 meters from the aerodrome reference point as specified in Ordinances of the Ministry of Transport.
